1. Introduction

These Terms of Service ("Terms") govern your access to and use of twittyn-games ("Service"), a content creation platform operated by twittyn ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Description of Service

twittyn-games is a browser-based platform that allows users to:

• Create customized brick reveal game videos using their own images and settings.
• Record gameplay as HD video (1080x1920) directly in the browser.
• Upload recorded videos to third-party platforms including YouTube, TikTok, Instagram, Facebook, and X (formerly Twitter).
• Manage video templates, media libraries, and upload settings.

3. Eligibility

You must be at least 16 years old to use the Service. If you are under 18, you represent that you have your parent or guardian's consent. By using the Service, you represent and warrant that you meet these requirements.

4. User Accounts

Certain features require you to connect third-party accounts via OAuth authorization (e.g., YouTube, TikTok). You are responsible for maintaining the security of your connected accounts. You must not share your access credentials with others. We are not liable for unauthorized access to your connected accounts.

5. Content Ownership and License

You retain full ownership of all content you create using our tools, including videos, images, and configurations. By using the upload feature, you grant twittyn a limited, non-exclusive, revocable license to process, temporarily store, and transmit your content solely for the purpose of delivering it to your selected platforms. This license terminates when the content is successfully delivered or when you delete it from our servers.

6. User Responsibilities

You agree to:

• Only upload images and media that you have the right to use.
• Comply with all applicable laws, including copyright and intellectual property laws.
• Comply with the terms of service of each third-party platform you upload to.
• Not use the Service to create or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Not attempt to reverse-engineer, decompile, or disrupt the Service.

7. Third-Party Platform Terms

When you upload content through twittyn to third-party platforms, your content is subject to those platforms' own terms of service and community guidelines. We do not control and are not responsible for the policies or actions of third-party platforms. You are solely responsible for ensuring your content complies with each platform's rules.

8. API Usage

The Service uses third-party APIs to provide functionality:

• YouTube Data API v3 (governed by YouTube API Terms and Google Privacy Policy)
• TikTok Content Posting API
• Meta Graph API (Instagram and Facebook)
• X API v2
• GIPHY API (for GIF search, subject to GIPHY Terms of Service)

Your use of features powered by these APIs is subject to the respective providers' terms.

9. Intellectual Property

The Service, including its design, source code, branding, and documentation, is the intellectual property of twittyn and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

10. Availability and Modifications

We strive to maintain the Service but do not guarantee uninterrupted availability. We may modify, suspend, or discontinue any part of the Service at any time without prior notice. We may update these Terms at any time; continued use after changes constitutes acceptance.

11. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or available at all times.

12. Limitation of Liability

To the maximum extent permitted by applicable law, twittyn shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from or related to your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or EUR 100, whichever is greater.

13. Indemnification

You agree to indemnify and hold harmless twittyn and its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Germany.
